Talk about ducking the issue.....
The government is pretty shady....okay, that's a good baseline - but more specifically:
Today the government indicted Jose Padilla after holding him for 3 years without charge or trial. Normally, one might be inclined to say that this is a good thing - that the government should indict and try individuals as opposed 'illegally' detaining them. But the bottom line is that Padilla's case has gone up and down the courts for the past couple years - and the courts need to rule on the legality of the government's actions
The Supreme Court was almost certain to hear this case - and the petition for cert. was just filed (to appeal Luttig's whacked out 4th Cir. Opinion), so by indicting this guy - the issue is now all but moot.
So, it's good that the criminal process is functioning, but it sucks because now the court has no case before it, presumeably to say that the government can't indefinitely detain American citizens....pursuant to the President's Commander-in-Chief powers.....at least when the guy is captured in the U.S..
I guess the silver lining is that the Executive is scared, at least scared enough to worry that the Court might tell them to stop doing what they're doing - so they're going to comply with the law.......for now.
