Is there any reason left to like football????

I was perusing the Times this morning and I came across this article, indicating that prayer is becoming a bigger part of football - I seriously Gabrielled a little bit.

What is this country's obsession with religion - why is religion such a part of public life? I'm not advocating a public policy such that religion is 'forced into the closet', because people should be free to believe whatever they want. I just worry that when groups (Football Teams, etc.) engage in common religious activity (most often of a 'Christian' variety) the legitimacy of the group is lent to the religion being demonstrated, such that groupthink takes over and voila - individuals feel compelled to conform. Gross!

If only the framers had substituted a "from" for that pesky little "of" - we'd be all good.

3 Thoughts for my 300th Post.....

First - the Eminem/iTunes commercial is awesome, despite the edited version of Lose Yourself......I really like the graphics and colors.

Second - I'm interested in this new movie Jarhead - and Jake Gyllenhaal looks really hot with a shaved head.

Okay, WTF

I'm totally studying right now - but I've been thinking about something for the past 15 hours and I need to blog about it. So, I'm taking a quick study break to address said thought.

Last night, after watching Sahara - I checked out my handy RSS feeds for news events that had occurred in the previous two hours, two painfully long hours away from my wired/wireless world - whatever - to the point:

BBC posted an article about abortion laws in Portugal, and more importantly efforts to relax them. The article focuses on the referendum to relax the laws, but I want to talk about why they're so strict to begin with.....

Portugal has the strictest abortion laws in the E.C. - such that you can only have an abortion if you're the victim of rape/incest or for the requisite risks to the health of the mother (to be fair there is a mental health exception). Of course this is consistent with the overwhelmingly Catholic population/influence - but in my mind, it's completely at odds with being a part of the E.C. and a party to the ECHR. I need to further research this - because in my mind if the ECHR has banned discrimination against gays and lesbians in the armed forces - certainly the covenant should uphold a woman's right to control her reproductive capacity......maybe a case hasn't been brought?

I'm totally going to look into this - and report back......b/c I love abortion and it should be safe and legal everywhere - even in churches.....

Maureen Dowd has another great column in this mornings Times - on the subject of Scooter. But the last few lines took a stab at Cheney and I thought they were worth a glance (especially 'Faith-based Intelligence):

Included in my voluminous iTunes purchases today was an iTunes Original Album by Melissa Etheridge. I'm not a huge M.E. fan, but I like some of her stuff & she's gay, so I gotta support the family! Anyway the album has commentary interspersed and before the song "Scarecrow", which I had heard before, but never listened to - she spoke about how she had written the song for Matthew Shepard.

So, of course I immediately 'listened' to the song - needless to say its been a little more than 7 years since he was murdered, but this song brings it all back so vividly....such that I found myself crying in my living room this morning.....so in order to make everybody's day - I thought I'd post the lryics.

So this morning I was bobbing around the Gay Pride iTunes Essentials - which are fairly good compilations - and I purchased a few songs. So right now I'm in the library listening to "Save Horse, Ride a Cowboy" which is much more apropos for Woody's as opposed to the Barco - but whatever.

Sophisticated Gay?

So, I don't claim to be the most sophisticated person that ever lived - in fact, I'm leaps and bounds away from that superlative.....nor do I know 'anything' about wine in any serious sense. Though I do know about a few wines that 'suck' and are absolutely nasty.....b/c they're really fucking cheap shit.

So in reviewing All the News the Fit to Print (for the Gay Community) - I came across an article on wine - and what to buy/bring for a variety of occassions. The article is here - and all I really have to say is that Luna di Luna is absolute shit - and nobody should buy it, let alone bring it to a party or serve it at a dinner party - there are plenty of comparably priced wines that aren't tacky or nasty.

Oh yeah - and any kind of Asti sucks - just don't go there.

I just bought 70 songs on iTunes.....what the fuck is wrong with me. Goddamn Lexis (I redeemed some LexisRewards fro 25 free songs) - But I couldn't stop.....I just couldn't.

.....thank god I never tried heroin - if that were the case I'd seriously be living in a gutter in South Philadelphia.

I wonder.....

I'm really quite curious.....if I stopped eating cheese, say next week, and changed nothing else about my diet - how much weight would I lose during a one month period???

Seriously - the classes are great, the professors are brilliant, the subject matter is engaging - BUT the single best thing about law school is 'the conversation'. I mean really - if you take people who are smart, nice, academically-minded, self-important & opinionated (myself included) - you're bound to get great conversation - and it's awesome & a really good time.

What's in a name?

An interesting discussion was had today in the student lounge regarding the granting of full civil marriage rights to same-sex couples and what we should call this 'inclusive' institution.

The position I take is one which was heartily advanced by Tom in today's discussion. (Qualification for Daily Hero Status - Agree with me / Be more liberal than me (that's how Marx got in) / Be damn funny) And that position is that the state should have nothing to do with the term 'marriage' - 'marriage' is a religious term and the state should have nothing to do with religion. Instead the state should have a term which describes the legally recognized union of two people - regardless of gender - e.g. Civil Unions (Tom wants to come up with a brand new word - I like this idea - but getting a consensus is gonna be tough) - and this legally recognized union would apply equally to hetero couples and homo couples. Now if any of those couples want to go ahead and 'get married' go ahead - more power to you - have your religious ceremony or whatever non-civil ceremony you desire and go ahead and call your union whatever you want - Marriage, Partnership, Civil Union, etc. But I am emphatic that the state should have nothing to do with the term 'marriage' - and I'll give two primary reasons why....

1. Marriage is an inherently religious term - regardless of the statistical outlier to whom the religious connotation doesn't come to mind - the overwhelming connotation of marriage - is man/woman - church - white dress - cake - rings. Yeah, marriage is largely a religious exercise that is sanctioned by the government ---- now it's understandably sanctioned - western society has a lot invested in this "two-person team" family unit - which is probably why the state sanctions marriage and not baptisms & bar mitzvahs - but it seems to me that utilizing a religious term is counter to the establishment clause and unnecessary - we have a more than competent Civil State which can record and affect the meaning of the union - no need for churches/temples/mosques to get involved with state affairs. Additionally the term is counter to notions of equality and justice - as historically access to marriage as an institution has been granted discriminatorily - Remember, Loving was only like 30 years ago - and Gay Marriage is legal in only ONE state. Which leads to my next point.

2. Marriage is associated with the inequity and discrimination mentioned above. If we as a society want to actually live up to our founding premise as a people committed to justice and equality (FOR EVERYBODY) - why would we grant equivalent rights but keep the same old nomenclature, especially when that nomenclature is fraught with religious meaning (this is why I like Tom's idea of finding a brand new word). Words are powerful - and I doubt that any among us, including those who would prefer that the state keep the term marriage, would have been okay with leaving the word 'colored' on the then-existing Southern lawbooks 50 years ago or allowing the same term to continue in usage in government records, such as the census - Outrageous - we wouldn't want any vestige or our discriminatory past to remain - even in the history books (kidding about the last thing....or am I).

Now, I don't have the clearest memory of the entire conversation - I think because I was desperately trying to understand someone's fruit analogy while at the same time trying to remain collegial and open-minded.....so I apologize in advance if I misstate anyone's argument - regardless - the arguments that I will paraphrase, while perhaps not the exact arguments that were discussed, are arguments that are put forth - and insofar that those arguments are advanced - my response would be appropriate.

1. There was a general allusion to the difficulties in updating statutes/Federal Tax Code to account for the proposed new nomenclature. I didn't take this point to be that it would be a hassle so why do it, but more of a we do things this way now, we can make this way fair, why go and change things that don't need to be changed. Fair enough, but as I alluded to above - I think that the word needs to go - I don't think that the term is fair - on its face - and it wouldn't be difficult to remedy the situation. Michael & Emily drafted a statute in about 5 seconds (independent from one another) when we discussed this topic - such that hey - Civil Unions are the new Marriage, Marriage is now wholly subsumed in a legal sense w/i Civil Unions blah blah blah. Have a commission that goes through existing law in order to make it complaint and as that is happening make sure that all new statutes comply with the revised terminology.

2. There was a fruit analogy which went to the point that marriage is marriage - it means man & woman - it's been that way for 2,000 - we shouldn't let the gays fuck it up (I say this in jest relating to what my classmate said, but it's a fair reflection of mainstream sentiment) - we'll give them their rights (as long as they shut the fuck up and stop having those damn Pride parades) but we don't want them calling it marriage b/c man & man does not equal marriage. So basically hetero 'marriage' = apples & homo 'civil unions' = oranges --- apparently they aren't the same thing (such that the different names are justified) but both will have the same rights. So it's basically an equal, but different naming scheme. Hmmmm......this sounds familiar......where have I heard this before......Oh wait, now I remember - it was phrased a little differently back in 1898 (I think they called it Separate but Equal) - but it was the foundation for Plessy - and legalized segregation. Didn't we, as a society (at least nominally) come to a conclusion about this policy about 51 years ago - yeah - it sucks - it's inherently unequal - and it brands the GLBT population as second class citizens.

Additionally - the government isn't recognizing a different concept w/r/to homo or hetero couples.....the concept is that the government is willing to recognize a union between two people - the government finds this union to be beneficial and as such chooses to incentivize this arrangement through the usage of government incentives and policies. But this isn't dependent on not having two penises or two vaginas in one 'union' - from the governments perspective there is no distinction between the gays getting together and the straights getting together - from the government's perspective there are no apple & oranges - it's all the same thing. So why bother with the two different names, unless your conferring a benefit upon one group of relationships by using a certain name....And that's exactly what the government is doing - its saying Marriage = Good, Traditional, Healthy, Normal / Civil Union = Second Class, Alternative, Different, Queer (but look how fucking accepting and progressive we are!). That's the jist of it.

In sum - I guess I have two points
1. separate but Equal = Bad, homo relationships and hetero relationships get called the same thing - Today, even those that wanted to keep the term marriage, agreed on this - Good Call.

2. Marriage = Religious, so the government shouldn't use it to sanction a relationship. This is a little more out there - and even if the GLBT rights movement is successful in getting rights that are equal - it's unlikely that this will change, but it's not the end of the world - I'm just hyper-paranoid about any religious influence/appearance in government.

I have a few "shout-outs" to give today:

First Up: Professor Brand
Every day in our International Business Transactions class, some student or students come to class late. This behavior clearly irritates him, as he immediately ceases class for anywhere between 30 seconds and 1 minute on every occasion where a student arrives in the minutes past nine, sometimes this happens multiple times during a class period, in order to 'accommodate' every additional tardy student.

The point is that he is obviously quite annoyed my non-punctual students - such that, if I were a few minutes late for class - I would sit that one out, as opposed to coming late - but then again, I'm not a big fan of pissing professors off.

So, today - a number of people came successively late to class. Five students in fact, and the last one arrived at 9:07 - at which point Brand stopped talking, then looked like he was going to freak out - fumbled some words (I'm guessing b/c of the growing frustration) - and then lashed out at the class. He said something to the effect that he hates interruptions (and he assumed that the rest of the class did as well) - such that if people couldn't be on time - they couldn't sign the sign-in sheet. Then he went further and exclaimed that if you are going to come to class late - Don't come at all.

Kudos Professor Brand, I can't stand the fact that the same people show up late every day - it's a distraction to the class and it's disrespectful to the professor. Of course - everybody has one time that they're a minute or so late - due to weather, transport, drug habit - but consistently being late is unacceptable.

I am NOT a morning person - I hate getting up in order to get to school for a 9:00 class (though oddly enough, I awoke at 5:30 today) - but I get my ass there and I get my ass there on time!

Of course if I were a Professor - I would have turned those insolent little bastards right around and told them to get out. But, interestingly - I learned that my/Michael's proposed response to this situation was not the most Draconian - that prize goes to Oliver, who proposed some form of finger-forfeiture policy upon arriving late......Hello there 8th Amendment.

Second: Tom Beline
I'm a huge fan of Tom today, for reasons which will become apparent in a subsequent blog post regarding the 'marriage' nomenclature and its relevance to 'the state'.

Third: Chris Reinard
Chris wants to stick it to the man for a career - and sue the shit out of big drug companies - I'm all for that - and he also concurred in the 'marriage' conversation alluded to above.

Lastly: Federalist Tony
Today in Evidence he was sitting across the room from Emily and me - he was discreetly flipping us off with the 'facial scratch' technique. But once the professor had moved such that Tony wasn't w/i his line of sight - Emily and I received a full-fledged two-handed 'Fuck Off' - of course she and I nearly fell out of our chairs laughing!

Who the fuck are these people? This is such classist and racist behavior, I guess these folks didn't get the memo that not only is diversity "one of America's strengths" (I put this in quotes b/c it's just a placating campaign statement that is supposed to make us feel good about how fucking progressive we are as a people, while not actually doing anything progressive) but it's also an absolute necessity for raising children. What demented parent would want their child to be raised in homogeneity?

And as expected this demographic is largely republican.....shocking, simply shocking.....

To Each According to his [pocketbook]??

I was reading an article yesterday in the Times about the need for thousands of home demolitions in New Orleans, and one of the things that struck me is that due to the recent quadrupling of the cost of performing renovations (all across the Gulf Coast) - a lot of people will be unable to restore their homes and consequently they will need to be destroyed (the homes, not the people). This is a prime example of where the government needs to step in and 'control' the market as opposed to letting the market function unfettered.

Why has the cost of renovation quadrupled - b/c there a hell of a lot of demand for contractors and construction services, and there isn't the requisite number of construction workers and supplies to fulfill that demand. But why should this surge in demand, fueled by a gut-wrenching catastophe, bring a windfall of profits to contractors, construction companies, construction supply companies? This is a wasteful wealth transfer that will in no way affect the supply of those available to rebuild/renovate homes - we're dealing with an event that requires an economically short-term solution....it's unlikely that there will be a substantial amount of capital redirected toward the construction sector for long-term use. Instead, construction services available will be rationed via the marketplace...the contractors will be able to command huge profits, while effectively pricing the non-affluent, non-insured out of the possibility of restoring their home.

These people will be forced to partake in some grand redevelopment scheme (which may or may not turn out to be a good thing - depending on who wins the developer/conservationist battle) or to leave the area altogether. This seems unfair to me, why should these individuals be deprived of the choice of restoring their homes, should they so desire? Because they aren't flush with cash? -- I think we could do things little differently.

For starters, why allow the 'market' to ration these limited resources - because, if the 'market' does the job, then only the wealthy will win. But it wasn't just the wealthy who were injured by the hurricane, it seems to me that we should be focusing on an equitable restoration/reconstruction - In my mind the gov't should step in and cap the costs of construction services (only throughout the recovery period) so that nobody gets screwed out of a 'restoration' option. Of course this won't bring any new 'supply' of construction services to the table, so the gov't could redirect resources (federal and private, with some sort of incentive package) in order to fill the gap. This doesn't seem like it would be that difficult - sure the gov't would be 'pushing' resources around that otherwise wouldn't be pushed, but really what's the harm. And - if a gov't incentive structure can't motivate enough resources toward the Gulf such that affordable and equitable construction services are available, then perhaps some form of lottery system should be implemented. I think in this type of a disaster recovery we as a society should really be focused on equity.

This storm hurt many of the residents along the Gulf - it affected some more than others, but it seems patently unfair that only those with the most money or those with the best insurance (read: those with the most money) should be able to put themselves back into the postion that they once were, before the storm. But our national obsession with the 'invisible hand of the marketplace' will do just that - the 'market' will rebuild Trent Lott's house, but the 'market' will level the Ninth ward. God bless efficiency......

This is why I love the French.....

Okay so about a year and a half ago the French passed a law allowing the government to sell-off part of its holdings in state owned utilities like GDF and EDF - I saw this article today which reminded me of the the whole situation. I love that the unions are sooooo strong and that if they feel the least bit threatened they aren't afraid to use a power outage to their advantage......even one specifically directed at the homes of government officials.

If only the AFL-CIO had half as much grit......

One more reason to hate football

Now, I preface this with the fact that I knowingly make a value judgment with regards to Football vis a vis other entertainment choices - It's just not my cup of tea. But aside from my own judgmental determinations there are actually some substantive reasons to dislike 'the game'. Namely, the fans.

My friend Chris was relaying a story to me from this week-end, when he attended the UD-JMU game at the University of Delaware. Long story short, some douchebag was calling one of the teams "faggots", etc. Chris valiantly took a stand and told them to shut the fuck up - Go Chris. But unfortunately this is not an uncommon experience (Throck relayed a similar encounter at the Pitt-Notre Dame game a few weeks ago) - what does this say for the game, that it attracts such bigotry into its fan base?

I can't think of the last time that I was at a theater or museum when I heard an audience member or guest call someone a faggot ...now I know that this isn't indicative of every football fan, and I know that there are certainly theater-goers that are homophobes. I bring it up, because it seems that it is still largely acceptable at a football game to call some one a faggot if they don't perform to your expectations.....how/why is this still acceptable?

Target

The other day I figured out that I spend about $50.00 - $75.00 a month on Odwalla fruit smoothies, this is a substantial sum of cash......so my innovative mind got to thinking that there must be a better way.....Voila, I decided that I'd make my own fruit smoothies - I've got a food processor and like 16 hand blenders surely this was accomplishable. (Okay, actually the whole 'make your own smoothies' idea was all Emily)

So, I need to get some form of tupperware-esque bottle/pitcher in order to keep my future product fresh and consumable for at least three days (b/c if I had to blend on a daily basis - I would totally give up and resort back to my Odwalla). Off to target I went. I hate stores like target - they're just too fucking big - you have to spend at least 20 minute search for the department of the store that contains the product you are looking for -- but alas, I perservered and I found and purchased two, small (1.5 liter) air-tight pitchers. Though there were two Target-situations that made this trip notable.

First, while looking at ladles (I'm in a soup-producing mood right now) there was a couple (man/woman) down the aisle from me looking at coffee carafes. They picked one up that they liked and then the guy looked to the back of the box and exclaimed "Damn, they outsourced - this was made in Spain. Put it back." (at which point I almost burst into laughter) The woman was like "let's just get it anyway" to which he responded "No, I'm only buying American" - I nearly broke down, so I quickly extricated myself from the housewares department. I mean really - anyone who has ever read a newspaper knows that some places can make certain things cheaper than they can be made in the U.S., and isn't this why people shop at Target so they can get stuff cheap. The 'outsource' comment was totally something that he heard a soundbyte about during last year's election, and has little relevance to the coffee carafe market. Though I suppose if the "made in america" trait of any given product provides the consumer with some value then all is well in the marketplace and we can expect to see more coffee carafes bearing an american flag on the box. I guess my general problem/concern is why this generates 'value' to the coffee carafe consumer? If this consumer really was concerned about American Coffee Carafe makers and their employees, then s/he should support nationalized healthcare such that american business can be more competitive in the world market. (More on this later).

The other interesting (??) thing that happened at Target was as follows: I had checked out and was proceeding to the parking lot, when I passed through the first set of doors (along with several others) - the alarm (inventory control) went off, so I stopped and turned around, and awaited a member of the Target Personnel to attend to the situation. A women came over, looked me up and down, said "Was it you, who set off the alarm?", to which I responded "Yeah" - then she looked at me and said "You can go". It made me wonder what their response would have been if I looked different or was dressed differently....it just made wonder.....I don't know....whatever.

Anonymous Posting

Today I contemplated removing the option of anonymous posting.....I really like to know who is saying what. Part of it goes to context and tone - I like to put a person w/ a comment so that I can better interpret what they are 'really' saying. But......though some bloggers prohibit such posting, I have decided to continue, for the time being, to allow such comments. I've largely been influenced by a recent DE Supreme Court decision that concluded that anonymous posting was a first amendment freedom. Granted, I am not bound to allow for this freedom, but hey - I'll do so anyway.....that's just the kind of guy that I am.

One last thing

....before 'Rear Window'

Yesterday in International Law - we were discussing the ICESCR (International Covenant on Economic, Social & Cultural Rights). One of the rights enumerated in this covenant is a Right to Food. Anyway there is much to be said about this covenant, its validity, and the U.S. position on it, but right now I just wanted to mention one classmates comments w/r/to the matter.

One of my classmates exclaimed that he disagreed with the right to food, because that would mean that the gov't would have to infringe upon the rights of others. The others being individuals whom the gov't would have to deprive of money or property in order to give food to those who were hungry. Basically, the gov't would have to tax people in order to pay for the food to give to people who couldn't afford it. Now remember that we're talking about food here - not iPods - we're talking about feeding hungry people, and yet this guy doesn't think that feeding hungry people is reason enough for the gov't to exercise its power of taxation.

The other point he made was that if the gov't provided a right to food - it would artificially affect the 'market' for food products. Yeah - I know - WTF, who gives a shit about 'the market' when there are starving people - I seriously don't get these crazy adherents to an unfettered free market. I mean that concept is such garbage economics - and it doesn't work - SEE the 1920's. Anyway the situation was appalling, selfish and ridiculous.

.....I wonder if this guy is remitting several thousand dollars a year to the Commonwealth of Pennsylvania for its funding of the University of Pittsburgh, or if he has opted out the Federally Subsidized Student Loans.....certainly if food isn't worthy of gov't tax dollars - neither is some jackass's legal education.

As Emily noted, one of the worst aspects of conservatism is that it breeds selfishness!

I have a new hero

Yes - another person is being moved into my personal Hall of Fame......Derrick Bell. I went to a lecture he gave today - I totally love him.

And he also signed a book for me.....super-cool guy.

Oh what a day....

In my mind, there really are two 'law schools' - the first is very practical, where one learns of corporate structures, taxation & securities - the second is very 'academic' where one takes 'crunchy save-the-world classes' and is confronted with incredible social/human problems that an inept legal system is ill-equipped to handle.

Generally, most students have a little of each. This semester (and next, and probably the two after that) is really heavy on the 'crunchy' for me - which by and large is fantastic - but today I feel mentally & emotionally drained.

I'm not going to really elaborate - but my day was largely spent thinking/talking/listening about the following three issues/problems:

1. Female Genital Mutilation: Cultural Relativism v. International Human Rights
2. Interminable Racism & the Genocide of African Americans in the United States
3. Race and Reproductive Freedom/Welfare Reform (with a little bit of Breastfeeding discrimination)

Accordingly - I decided against going to the Film Festival tonight - I don't think I could have dealt with a movie about Hate Crimes.

Yeah - Injustice is tiring. So - I'm going to pop in an old Hitchcock movie, have a glass of wine, and chill out.

So I totally need some more time in this day - I really want to blog about healthcare and about Rwanda - but alas - I also need to get up tomorrow morning - b/c I totally can't afford to keep driving to school. So this week-end: Blogger, here I come!

Wow - that goddamn shoe and the fucking other foot

So about 2-3 weeks ago Emily & I (among others) participated in a healthy back and forth of 'degrading sexual terms' and their respective inherent meanings and offenses.....I largely took the position that people needed to grow a thicker skin and stop being so sensitive.

So, today in the context of a conversation regarding helping out a friend prepare for an academic exercise, the 'friend' commented that he needed a 'man' in addition to the women who had already agreed to assist him. Accordingly he indicated that neither Emily nor I would be able to help him out. Alright - so fuck that. Gay men still have penis's and being gay doesn't make anyone less of a man. It is that kind stupid bullshit thought process & attitude which reinforces homophobia and outdated stereotypes.....whatever - I'm definitely being too sensitive....but whatever - it pissed me off, especially because this utterance was from one of the guys that I considered to be in the miniscule minority of straight men who are largely comfortable with gay people and supportive of gay rights n a real sense and not in that surface PC sense.

Christ - I'm being such a baby......time for a glass of wine and some slumber.

Bare Minima & Fuzzy Math....an Updated Post (Money Pitt?)

In an effort to keep from annoying Greg and to be ‘fair’ I’ve pieced together this conversation into one post – Any comments that are left – I will update into this post for ease of reading.

So - I'm going to totally bitch about two things that law students bitch about a lot - Money & Grades.

So let me paint you a picture of some of the events surrounding my arrival at Pitt Law in the fall of 2004:

I applied to a bunch of law schools for matriculation in the Fall of 2003 - I was accepted at several of them, including Pitt. Pitt also offered me a generous scholarship - $12,000 a year for 3 years as long as I maintained a 3.0 - this was apparently based upon my LSAT score. Regardless - I wasn't sure that I wanted to start law school in 2003 - so I inquired as to the ramifications of deferral, specifically w/r/to the scholarship. The response was a "We can't guarantee anything" (Wink Wink, Nudge Nudge) but you can expect the same next year. Whatever, so when I sent out my 2004 Apps, I sent a letter to Pitt re-activating my admissions status. Long story short - NO MONEY FOR ME. Apparently their [Pitt Law] application pool's AVG LSAT score increased a point or two placing me outside the range for free money. Whatever.

But I still decided to go to Pitt b/c I liked the school/city/program....and because they told me that if I did well that I would be eligible for Cash during my second year. Promises, promises......b/c I did fairly well my first year - and yet still NO money.

Whatever - I had accepted this....until today, when a certain letter was deposited into our student mailboxes which has fanned my waning flames of discontent.

The letter was from the Dean and it related to Bar Exam passage rates. Apparently if you are in the Top 30% of your class you have a 98% chance of passing the bar, whereas if you are in the Bottom 30% of your class you only have a 50/50 chance of passing. How does this relate to my aforementioned rant......well because apparently those who have a 3.04 GPA or below are in the Bottom 30% or our class, and all those people who received scholarships based solely on their LSAT scores only need to maintain a 3.0 in order to keep their scholarships (and I'm told that this is sometimes flexible).

So here is the practical import of this information - you can be getting a 5 figure scholarship from the university based on your score on a Standardized test and maintain this scholarship as long as you don't fall below the 28th/29th percentile (tough threshold for tens of thousands of dollars in free money) OR you can be me who is above the 70th percentile in the class and yet I get no money b/c my LSAT score was a 162 as opposed to a 163.....What kind of fucked up arrangement is this.

Now of course I don't begrudge anyone who is receiving a scholarship, the benefit of that scholarship - but you have to admit (as Throck noted on her blog) that its pretty fucked up that one can be a "Scholarship Student" and be nowhere near the top of the class - I mean really, the policy is just a touch inequitable. And it really fucking disadvantages me!

GREG’S COMMENTS – 10/17/05

Think about it this way. The policy makes complete sense when you think about the motivation for giving the scholarships. That motivation is primarily, and I would submit, completely, to attract students with higher qualifications to attend the law school, regardless of what the school determines those qualifications to be. Why is this their motivation you ask? because a major factor in determining law school rankings is the LSAT scores and undergrad GPA's of incoming 1L's. Therefore, I would submit, a more sensical policy would be to get rid of any GPA mainenance requirement whatsoever. It was an exchange relationship... the law school already got what it wanted when it got a student who had at least a 163LSAT score to enroll, the student get what was promised regardless of subsequent GPA (assuming ability to actually stay in school)

As today's letter indicated - Performance relative to ones classmates seems to have some correlation to Bar Passage, and I'm willing to wager that grades also have a correlation to employment at graduation.

Accordingly - I would submit that at are probably a wash when it comes to 'the ranking'.

Further - do you honestly think that the maintenance requirement should be eliminated.....what kind of perverse incentive structure would that create - Talk about no motivation to even put in the bare minimum - If someone is getting the cash regardless...who cares.

I'm not saying that Free Money shouldn't be awarded on the basis of LSAT scores - I'm just saying that it should also be awarded on how one performs once they're in the door - it seems like a pretty equitable principle to me. This isn't "The Program", it's not Big Ten athletics - and nobody at Pitt Law is such a prized possession that the Law School needs to have them. Such that they need to 'make it happen' by giving tens of thousands of dollars for an LSAT score - 'no questions asked' - That's just plain preposterous!

First of all it is annoying that Andrew had to amend his original post to respond to my comments thereby circumventing the process of argument, response, rebuttal, rebuttal of rebuttal etc.

It would be much more fair to keep responses in the comment box so that one may read the progression of the conversation instead of just getting one side of the story first, or in many cases, just getting one side of the story period. (empirical evidence shows that comments on blogs are read only 39% of the time)

If you disagree with me that 23% is a "major factor" then you are just plain silly. That placement success makes up "a comparable 20% of the ranking" detracts in no way from that statement.

Yeah... so? My point was the law school has made a choice that it will make an effort to raise or maintain it's status/ranking by trying to raise the LSAT scores of incoming 1L's. Again, that placement/bar passage is also a factor in rankings in no way suggests that the primary reason for giving scholarships BASED ON LSAT SCORES is to try to increase their competetiveness in that area of law school rankings.

In addition, since law school grades are heavily curved and placement is based very much on that status of the school to begin with, The "placement" factor seems even less meaningful. It creates a cyclical situation... placement rates based on status/ranking of the school based on placement rates based on status based on placement rates etc. If we had a rankings system based only on placement rates there would never be any mobility amongst schools. I guess what I am getting at is the law school can more directly control the LSAT scores of its students by offering scholarship money than it can placement rates.

Yes I do. "who cares", you ask? you shouldn't be in law school if you only want to make the bare minimum to maintain your scholarship. Competition and the desire to get the job of your choosing post-graduation should be all the motivation a scholarship, or any other, law student needs.

I certainly agree to some extent that law school cashola should also be awarded on how one performs once they are in the door. It is my understanding that, at one time, Pitt did just that, granting new merit scholarships to those who performed well their first year. However if they want to improve their status, I maintain that pre-admission awards do more to attain that goal than post-admission awards. This is due in large part to the curve. while it is not exact, for the most part, the cut off GPA lines for those who are at 30%, 50% etc. of their class ranking is pretty much pre determined. If Bob doesn't get the 3rd A in legal process, chances are pretty good someone else will.

I don't know how much of the above makes sense, because I'm so tired I'm barely conscious, but it makes sense to me and my mommy says that's all that matters.

GRANT’S COMMENTS – 10/18/05

Your math is screwy. The 3.04 number is for the class of 2005, a class that has had two years of non-curved grades in order to lift their gpa from first year forced curve grades. The 30 percentile gpa for class of 2006 was a 2.95. Extrapolating these numbers backward, and forward, it says to me that the 30 percentile number is a 2.8 for our class. Which definitely wouldn't qualify for scholarship renewal. Don't get too overwrought. Your emotions are getting in the way of your reason.

I’m going to respond to Grant first, because I want to….and it’s my blog and I can do what I want.

I don’t really care about the math – it doesn’t need to be exact to make my point. I didn’t have the letter in front of me when I drafted the post b/c it doesn’t matter all that much? It is clear that regardless of any extrapolation, the 3.0 – ‘I get to keep my scholarship’ - number isn’t in the top half of the class. So the irony of the situation, that the majority of your classmates do better in school and yet you still receive a scholarship, still exists.

BTW the ‘you’ that I’m using is a general ‘you’ – not specifically directed at anyone.

Also – as per extrapolating backwards – is there any reason to think that we should extrapolate backwards???? And with only two previous data points, is it wise to assume a linear relationship?? I’m not saying that it doesn’t, I’m just curious.

And yes – I’m a touch pissed about the situation, but just because I am [angry, happy, sad, etc.] and my math is a little fuzzy, it doesn’t follow that my reason is flawed.

I hope this ‘combined’ post satisfies your visibility concerns – the reason that I updated my post was that I hate commenting on my own blog and then getting that annoying e-mail notification from myself – I wasn’t attempted to silence your voice.

As per LSAT scores – My point wasn’t that they didn’t matter when computed into the Law School Rankings; my point was simply that they weren’t the ONLY factor (by themselves they only comprise 12.5% of the ranking). I most certainly agree with you that the law school gives scholarships to get higher-qualified applicants to matriculate. I was only saying that it is a non-sensical policy such that the law school is giving away a shitload of money based on a Test Score (which does impact their ranking) and continuing to fund that stream of cash flow based on minimal relative performance criteria. Whereas, people who perform well it law school, who don’t necessarily have the 163, also greatly contribute to the law schools ranking….employment at graduation, near certain bar passage, journal activities (which impact the 40% peer assessment criteria), etc.

I’m only saying that there are plenty of people who don’t have the 163, who may be contributing to ‘the ranking’ more so than the 163ers – and they don’t see a goddamn dime from the law school.

I’m simply making a fairness argument – if the school is going to utilize is MONEY to affect it’s ‘ranking’ (and I’m not so sure that is the best academic use of funds, but whatever) I think that they do so in a very inequitable manner.

And though, you may be right such that during the application phase the law school won’t be able to predict performance or placement, and thus may be forced to rely on LSAT – that doesn’t mean that the Law School is powerless to adjust its funding during a class’s respective second and third year. Certainly a base proposition of ‘better than average’ isn’t out of line in order to keep getting your ten grand.

And as per your last point that “you shouldn’t be in law school if you only want to make the bare minimum….” I agree with you entirely – but just because that statement is correct in the abstract doesn’t mean that it translates into reality. This is seriously almost identical to something I said earlier about healthcare…”We all know what we should do, but often we don’t do it” – I think that has some relevance here – because you’re absolutely right – Everyone in law school should be working to do their absolute best, but how many times have you or I or any of us said “Eh, fuck the reading, let’s go have a drink.”

I would submit that LSAT Money recipients who would be tempted to say “Fuck the reading” might do so less if there were higher maintenance requirements. This is just my hunch, but it seems logical – taking into account human nature, etc. – But of course, this isn’t something that I’m really willing to go do an outright sociological study to prove….so feel free to disagree – but I still think I’m right.

Lastly, as I said in my first post – I’m happy for everyone on the PittLaw Dole, but I just feel like I’ve been continually fucked over by the Law School Money Department. And ranking’s aside – It still seems a little unfair to me that I’m above the 70th percentile and get no money, yet people hanging out at the 30th percentile are raking in ten grand a year.

It's about the brand new GM deal - where GM gets to save a billion dollars a year and GM's workers and retiree's get to pay for more of their health benefits - So 750,000 are now worse off.

I know the argument - so spare me - "Well....if GM continues to lose money....blah blah blah....750,000 people would be out of a job" - Well, first of all - NO - b/c Toyota would probably buy GM if it went bankrupt - and the only people to lose their jobs would be the trash at the top - Good Riddance. But also - This isn't a zero-sum game - IT isn't either workers barely make enough to feed their family and they 'pray' that none of their kids get sick OR they are unemployed. We can certainly do better as a society - they're are other options. Holy shit - lets shuffle some resources around - this country has more wealth in the top 10% of its income distribution than it know what to do with. And I can't imagine that some greedy bastard is going to be like "I won't pay an extra 5% of income tax this year on my $1,000,000 per annum salary, in order to prevent people from getting sick or starving or living in squalor" --- actually I think I'm right about this one - that greedy bastard would probably say some combination of "Market Economy", "Personal Responsibility" & "Self-Determination"........oh yeah, I almost forgot "Class War"

My Comments on Michaels Blog w/r/to National Healthcare

Yeah - I feel like tossing in my two cents on several points of your discussion.

1. By and large consumers are ignorant and take actions inconsistent with their long-term well-being. This is the unique by-product of the market economy and human nature. We all know that we need to save for retirement, health emergencies, etc….credit cards are bad, live below your means and all that jazz…..but not that many people actually do these things. Which is why gov’t’s provide ‘an out’ or a safety net such that we as a civilized people realize that certain bad decisions should never lead to someone being hungry or homeless or left to die of a debilitating disease w/o comfort and treatment. I think most people are comfortable with the proposition that if you’re an idiot and don’t plan for retirement, you shouldn’t complain when you can’t buy a condo in Del Boca Vista. I think most people are uncomfortable with the proposition that if you’re an idiot and don’t plan for retirement, you shouldn’t complain when you’re forced to live in a box during your final years.

The same holds true for Healthcare - people make bad decisions, and the honest reality is that ‘the people’, as in all of them, will never be educated sufficiently OR take interest sufficiently to plan for their own health emergencies. And I can’t imagine anyone with a soul saying “Hey - sorry - you weren’t responsible enough for your own health care, so go ahead and die your painful and preventable death.

But hey - the devil you know is better than the devil you don’t know. So, since we know how people are and what the consequences will be (and are) we can plan accordingly - and the best plan is a nationalized health care system.

2. The American Healthcare System - is a stunning example of market failure. Even the most ardent Chicago schoolers will admit that in our practical reality, market failure can and does exist. Just take a look at the incentive structures w/i the Healthcare industry in the abstract and then look to our practical experience - it’s really quite clear. Above, Michael noted that simple fact that our for-profit healthcare industry has some ‘interesting’ incentives w/r/to keeping people health and paying for their treatment. Let’s just take that and look at our current system, the adminstrative overhead of our private, market insurance industry are about 30% - why? Because insurance companies spend a lot of money paying people to try to avoid paying claims. How can anyone claim this is efficient? And if it’s not efficient, why in a country religiously dedicated to economic efficiency do we continue down this path…..something tells me to follow the money….

3. There is absolutely no question that our market-based healthcare system is the most expensive in the world…..and what are buying ourselves - mediocre health standards compared to the rest of the western world. So as to the “Lets disagree about how best to provide healthcare” - there is really no disagreement outside of an ideological straightjacket. The data is unequivocal - national healthcare systems are cheaper and better - at least amongst comparable western nations.

4. Also, one last thing - this is of particular interest to me, but not really relevant to your post/discussion. And I have only anecdotal evidence to support my thoughts - though they are logical. I wonder about the motivations of the people we (America) attract as caregivers to our healthcare system. It seems to me that other countries (France) have it better. I say this b/c we pay doctors exorbitant salaries, in order to pay for their exorbitant student loans and their exorbitant medical malpractice insurance. Whereas the French don’t - med school is free to those who are smart enough and have the desire to practice medicine. I think that our system focuses so much on money that we may sacrifice individuals (or place them out of the ‘market’) who are truly devoted to patient care - but they don’t want to go through the bullshit of practicing medicine in the U.S. Yeah - again - this is just something that I think about from time to time - and it makes me wonder if we should take another look at the whole system.

Sadly, it is unlikely that we will have significant movement in the U.S. toward national healthcare, simply because of the power of the insurance companies here (BTW, guess who made out when Texas enacted Tort Reform….I’ll give you a clue - it wasn’t the consumer). But this is a curious situation, where the market system - stalwart of efficiency - is second best in sum and substance to a state-run bureaucracy…..though I guess anyone who would classify Public Health as a Public Good wouldn’t be surprised.

Rehashing Part II

Just an update.....Shortly after the previous blog post - Emily came back from Panera and sat down with me. At approximately the same time - some of the Rehashing individuals were setting up some tables near by for what would amount to be a pointless SBA meeting, yes they were still talking football.

What happened next you ask.....Emily started making some comments under her breath (in response to the conversation upon which she was eavesdropping) and then she fully engaged the rehashers with some comment like "Somebody (whose name escapes me) is playing with somebody else's (another name not retained) recruits....blah blah blah blah".

Whatever - she's since apologized for bringing that ruckus to my peaceful studying table - but I still had to mention it.

Rehashing 'the game'

What the hell is wrong with people?? Seriously - all day, all I've been hearing is people rehashing football games from this week-end. Notre Dame losing to USC (not Throck btw) - The Steelers losing to the Jaguars - Penn State......OMG really people - who the hell cares? I can understand the "Hey did you see the game?" with the standard "Yeah, such a shame" response - but we're talking in detailed analysis about every play and every call that every official made.

I mean, why bother spending hours of time on the pointless postgame conversations reliving every stupid play....

Granted - I'm not a fan of American football (in case you haven't guessed) - so maybe I'm being a little judgmental - but I don't think I'm being 'that' judgmental - because these people are crazy - Come on people - it's a game - it's for entertainment - it's supposed to take you mind off of the vexing stuff that is reality - just leave it at that. Watch it, be entertained and then be done. Christ.

But if you've gotta dissect the entire 3-hour ordeal - have a little courtesy and drop down the volume and stop gesticulating like you're throwing a pass. Because you look ridiculous.

Distractions....

Oh my FSM - I'm in the lounge trying to read.....and these fucking 1L's are sooo distracting & annoying. Do they have inside voices - seriously - I don't care about their conversations. And it's not even like they say anything worth eavesdropping on.....Treesus Chrust!

Brand New Spring

So - I dropped 11 out of my 15 credits for the spring semester - which means that I've completely juggled my entire schedule. I'm really going with the theme of "If it is a relevant [read: Bar Exam] class, I'm not going to take it". The sole exception being Estates & Trusts b/c I think that may be an interesting class.

So (drum-roll please), my new Spring 2006 Schedule is:

Names, Names, Names

I'm saying everything in triplicate these days....but that's not the point.

I just saw a commercial for the Black Movie Awards....they're being hosted by Cedric the Entertainer. I'm really uncomfortable with his name. Like, seriously - who does that? It's not like I go around telling people to call me Andrew the Law Student, and Emily doesn't ask to be called Emily the Cat Lady.....I mean for real - why is it that famous people don't have to abide by the same rules of nomenclature that the rest of us do.

i did NOT say that the reason i didn't like blink-182 was because they were "radio-friendly". i said that they were too poppy/radio-airplay/mass-produced-sounding for my taste. and yes, i'm a music snob. guilty as charged. but i certainly don't draw broad lines about what is and isn't played on the radio, and then write off those who are played on the radio as "sell-outs". i mean, yes, i think the killers suck and i wish they'd just crawl back under the rock that hit them on the heads as very small children, but i do like the strokes (eat it, people; i like the strokes) and i like the white stripes (particularly the new album) and i like weezer (well, before they got the new guitarist and started to sound like blink-182). but by and large, the music i like is a little, erm, less-refined than the pretty-pop shit that becomes the soundtrack to MTV's the real world and various WB shows-for-teens.

Today we [emily & i] were in my car - I had a mix on the radio - a Blink 182 song was playing - I think I commented that I really liked the song.....to which she replied "Yeah - I don't like them - they're such a radio-friendly band" - Hello can we say snob - I guess I'm not cool because I happen to enjoy music that occasionally graces our airwaves.

Oh yeah - and then after that - she checked out a guy and said "Wow, you'd be really hot......if you weren't twelve years old".

Ode to Productivity

So - I accomplished soo much today - right...about that - I did nothing today. I picked Emily up - we went trolling for breakfast, then went shopping for pants and make-up (just for her on that one) - right and by the time I got home - I did dishes , checked e-mail & started watching TV - so I've done none of my reading for tomorrow - as such it's doubtful that I'll be in IBT.

Ode to pre-school

Thank God for being able to save drafts.....I totally would have forgot to finish this post.

So seriously the other day - I was getting ready for school - and I thought to myself - "Self, maybe you should drive to school today"....and on that particular morning - I happened to agree with myself....so I went in search of my car keys. Therein was the problem - I couldn't find my keys in any of the normal places that people keep their keys - the table, the pocket of yesterday's jeans, my shoulder-bag....so I did what any rational adult would do. I threw a temper tantrum reminiscent of my days as a 6-year old. I literally started throwing shit off my coffee table, I dumped out my school bag, I threw some vitamin water across the living room....and then I finally decided to just suck it up and take the goddamn bus. But the funny thing was - that I was sooo damn angry - over misplacing my car keys....damn I seriously need to chill.

Follow-up.....the next day I calmly located my car keys underneath my couch.

I [heart] Throck

Just another reason that I fucking adore Emily: We can have a phone conversation, become bored....and not have to worry about being polite....we can just say to one another "Wow, this is boring, I'll talk to you later" - no offense, no hard feelings, simple - quick - painless.

What a way to start your day

I came across this news story this morning, which really made me smile.

It turns out that only 26% of Americans believe that the Bush presidency will be seen as successful........silly optimists.

What a difference a day makes

Just think - yesterday at this time I was drafting a gushy drunk blog post about loving my friends....whereas today - I just got home and I'm totally sober. Victory is mine.

Tonight was pretty much a blast - though my ears are still ringing a little bit.

First of all - I had never previously been to the South Side - big mistake, the South Side looks like it could be a pretty good time - lots of restaurants & bars.....down side of course is that it's really far away. But whatever - it warrants further exploring. As Emily said - it feels very Manayunk - and as I said "without the greasy el-line".

Anyway - the venue for this party was actually pretty cool - old movie theater partially converted to allow for a stage and a bar - but I liked the feel of the place - though not a big fan of my feet sticking to the floor - but hey - give a little, take a little.

As per the bands - the first band sucked - but the lead singer was awesome - she was a cool quasi-punk chick, the second band rocked but the lead singer sucked - hello anyone else see a trade to be made?

The band that was launching the CD 'Adam Evil' started playing around midnight - and they were really fucking good - I really like the strings - there really isn't enough Cello & Violin in Rock! I'm actually feeling compelled to purchase their CD.

As per the people - it was a good group - of course my car had the best people - Me, Throck, Jen & Oliver - but Chris, Greg & Tom were there too - Laura met us at the door (wearing a stunning little black dress).

Emily & I were basically dressed alike - both in green sweaters and dark jeans.....but I had way cuter shoes. Oh yeah - and both Chris and Tom were doing the whole 'sportcoat' thing - which as a general matter I'm on the fence about - I will say though - I like Chris's jacket. But Tom, dressed like a young republican, actually had the gall to exclaim that "For a gay man [I] ha[d] the worst sense of style" - right - big fat fuck that!

Whatever - then we went to a party for Anne - it was her birthday - which was okay - there were lots of cool people, and a few not so cool people, and a really cool dog - but all in all it really wasn't my scene.

Happy Birthday Anne!

Oh yeah - so, I rock - I had a pretty fucking comprehensive evening - I had one light beer and NO cigarettes!! Yeah - I'm sexy, I know it.

Triceritoptic Brilliance

So last night I was a little bit wasted - and I would totally be lying if I said that I didn't want to smoke - because I REALLY wanted to smoke - thankfully I was with my two better halves (yeah - that makes no sense) - so just when I had compromised Emily and she was willing to go get cigarettes with me - Grant stepped in and was like "NO"! So long story long - Bravo friends - for keeping me honest.

Side note: It was quite funny when Laura met us at the bar. She was smoking - and Emily said something to the effect that it was good that she was smoking b/c we [Grant, Em & I] need to learn how to be around smokers. The funny part was that about 2 minutes later we all realized that we [the new non-smokers] were all staring longingly at Lauras cigarette. Whatever - we were strong.

China Palace

It just so happens that the best Chinese food between San Francisco and New York happens to be right down the street from me. Now, there is the possibility that they use MSG in their food - Michael & Steph are currently investigating, but frankly I don't care what they use - because it's fucking delicious.

The only downside is that it's a little bit of a rip off - I ordered General Tso's & Pork Fried Rice and it was almost $20.00 - but then again - it's really really good.

Breathalyzer

Yeah - after reading this morning's early-morning post - I'm totally installing a breathalyzer on my fucking computer - b/c my drunken nonsense really shouldn't be recorded in cyberspace.

What fun today was

This morning I awoke with a touch of a headache (note to self - don't mix bourbon & beer) but I largely felt fine.

I decided to call Throck - to see if she wanted to get a greasy breakfast - to kill our respective lingering hangovers - She answered while vomiting - Classy! So my breakfast plan was dashed, but I was of course concerned about Throck - so I offered to take her to school - b/c really who wants to ride a bus when you have to puke.

Anyway - so this is the best part.....We're heading down 5th and I was in the left hand lane....when Throck is like "We NEED to pull over" - so being the masterful driver that I am - I promptly made a right hand turn across two lanes of traffic and pulled right up to the nearest curb. Which coincidentally was in front of a church, where Throck proceeded to vomit whilst pedestrians walked to and fro. Good times.

Okay - now flash forward 2 hours.....throck is out of class and Michael, Throck & I are leaving the law school.....

Back on 5th - we have to pull over again - this time, in front of St. Pauls Cathedral - Throck didn't really vomit - she just spit a little bit, kind of disheartening to me - I was hoping for a little projectile vomit as a tribute to Pope Fascist II. But whatever - you can't always get what you want. Though a few minutes later - we had to pull over again - where Throck did puke alongside a gas station.

And after I we dropped michael off - there was one more instance of vehicular vomiting - at Throck's chosen lunch venue, the local McDonalds - in the drive-through line.

Right so, although this absolutely sucked for Emily - it was mildly amusing for me.......

Schadenfreude

I feel like I've been inundated with this term recently.....which is odd, because schadenfreude doesn't usually come up in regular conversation.....but a few weeks ago a group of us were have a conversation in the lounge - largely about the word, its meaning and its effect relating to a variety of law school rumors. Last week - it was used emphatically in one of James Spader's closing arguments on Boston Legal. And today - it's in the concluding paragraph of Paul Krugman's column (a good read BTW).

Right - so inundated wasn't really the appropriate term - but still 3 encounters in 3 weeks with a term that I've probably used 3 times in the previous 3 years - interesting....very interesting.

The bestest night ever

So you know who I love - yeah that's right - GrANT, LAURA VASH, Emily, Grant, Tom, Oliver, Sharonda & Greg (except that he left to go make out with a 1L) - and I love these people because they are the greatest human beings ever - they're fantastic & hysterical and just plain fabulous.

Though I've got to say - Tom - the whole 'intimidating' thing was a little annoying.

And I almost got myself in ttrouble tonight - thanks McNally for saving my ass - Love you lots!

National Coming Out Day

Happy National Coming Out Day Everyone!!!! My friend Laura also has a birthday today - which is why hers is the only birthday that I never forget. But I'm thinking about purposefully not calling her because she didn't call me on my birthday this year. Oh, what the hell - I'll giver her a ring. It's not like I'm crazy and keep track of this stuff.....

Actually I totally have a friend, he makes a list of the friends that call him within the 24 hours that are his birthday - If you aren't on the list - you don't get birthday recognition from him. I mean, it is definitely a fair/reciprocal system, but man.....who really cares that much about birthdays anyway......well - I guess emily will have to from now on - that whole 'I'm in my forties now'-thing.

One last homo-topic - Today in Evidence Friedman was giving a hypo which somehow involved him killing himself b/c he found out his wife was cheating on him. In the hypo - his wife was cheating with another woman (and he was being serious) - so - Thumbs Up Joel, for acknowledging the possibility, but not being a douche about it. Of course there's a Thumbs Down also, yeah - its for the conspicuously conservative member of the classroom who laughed - because yeah - it's really funny that there are lesbians out there - hahahaha - I just can't stop laughing. Whatever douchebag....what's more hilarious: Two women fucking? or Christianity?

Four Major Decisions in 40 seconds.

This morning, after awakening from a blissful 9 hour slumber, I had a surplus of time before I had to trudge out and wait for the bus. Usually - I'm buttoning my shirt, putting on deodorant, and tying my shoes all at the same time - as I run out the door, attempting to catch a bus, that I logically know has already passed - and then I wait for 15 minutes for the next one. But this morning I was showered, dressed and ready to go at 7:39 (I usually try for the 8:03 bus) - so I thought I'd make a cup of tea and chill.

First let me say - I like this whole 'not rushed' thing in the morning - it's soooo nice - and I used to know what it felt like on a regular basis - back before I had 9:00 a.m. classes - God how I miss first semester last year.

Okay so, I attempted to have my tea and chill, w/o music, tv or the dreaded internet. I think my brain was rather shocked at being forced to self-stimulate that early in the morning.....so all of the sudden I was making resolutions of things to do and not do. Such as:

I watch too much TV - I think that a blanket ban on non-news programming is appropriate - there are so many better uses of my time - Hello - I could have learned 5 languages in the amount of time that I've wasted watching and dishing on Desperate Housewives.

Second, while no longer an ashtray - I'm still packing a little extra heft - this shit needs to go - I've got about $5,000 worth of clothing that I can't wear - b/c I look like a blood sausage!

Third, I'm not going to Paris, London, or anywhere else over Christmas - I've got to stop the Credit Card living.....at least until the spring, when Stockholm is a realistic possibility.....

Fourth, cutting back on the coffee - I'm limiting myself to 3 shots of espresso a day or that equivalent. Largely because my heart is probably like "Slow down there little camper - I really can't beat that fast" and because I'm supporting Starbucks way too much, I mean I'm totally being a sell-out to all that I hold true......and for what - for what I ask? I really sweet latte and a shitty M&M cookie.....my god...who am I?

So that was my morning as of 7:44 - with more time to kill, I checked my e-mail and read the news then left my house in just enough time to miss the 8:03 bus.....brilliant.

Good-bye crutches, I can walk on my own again!

I didn't wear a patch yesterday or today - and I feel great. I don't feel on the verge of a crack attack 24 hours a day, Coffee doesn't totally fuck with me anymore & I still don't want to smoke. And last night - I got a perfect nights sleep - and Sweet Hosanna it was all that I'd dreamed it would be.

So Fuck You Cigarettes & Fuck You Nicotine - you are dead to me!

I think that 'the patch' and I are going to part ways

I feel like shit today - I couldn't get to sleep last night, and I'm blaming that on my nicotine patch (even though I stopped wearing it to bed) - I think it just cracks me out more so than I need to be cracked out. So I think I'm saying farewell to the patch, I'm beginning to feel like emily did when she first quit smoking - I just want all the bad stuff from smoking out of my body, including the nicotine. I just need some finality.....and now I'm moving on, because seriously it's been three weeks.

Well - I knew it couldn't last. That is, my perfectly agreeable relationship with Brennan.

Last week I came across an Evidence opinion of his that I really wasn't a big fan of.....but I wasn't totally against it. But today - I'm reading my IBT and there's a little review section on Jurisdiction (Oh how I miss Hellman). Anyway the Worldwide Volkswagen opinion made an appearance - I really like this opinion in general - and Brennan dissented....WTF.

The ECHR ruled that prisoners can't be denied their respective rights to vote under the Eurpean Convention on Human Rights. I wish that the U.S. were so bound by the Court's decisions. Regardless - Britain and 13 other countries (i think it's 13) need to change their laws.

The U.S. Senate - stalwart supporters of human rights?

So the U.S. Senate voted 90-9 to include language setting standards for military detainees in the latest DoD appropriations bill. It's John McCains doing - probably because he knows how much it sucks to be a POW and doesn't want the U.S. to inflict the same kind of shit that he went through onto others.

The curious part is that the White House has threatened a veto....because the language is 'unnecessary and duplicative' according to Scott McClellan. But McClellan went on to say that McCain's language would 'would limit the president's ability as commander-in-chief to effectively carry out the war on terrorism' - now if it's duplicative how would it be limiting the president in anyway????

Let's just be honest - W. gets a little excited (yes, probably sexually) at the prospect of executing and torturing people. The president has a fetish for inflicting pain on and ending the lives of other human beings. He must have a really small dick - but like most average american men with the same plight - he should just go out and buy a Mustang or a Harley and STOP FUCKING KILLING AND TORTURING PEOPLE!

Such a shitty day

So Thursday - usually a great day signaling the end of the week, is turning out to be a really shitty day.

I over-snoozed my alarm clock - forcing me to drive to school again - only to find that nearly every parking lot was full - such that it took 25 minutes to park my fucking car.....and I missed my class.

I think my OUTlaw meeting pretty much sucked - it was basically me - 12 of my friends, another 2L and 1 1L - I don't know what to do with this situation. I'm really conflicted...but whatever.

I ended up calling a friend of mine "brawny" which apparently carries the same connotation as 'stocky' or 'big giant fatso' - which wasn't what I meant at all. I'm really tired of words and my misuse thereof - humans really need to an ESP form of communication - so that people's actual intent transmits to the listener (perceiver).

I body-checked some kid in the lounge - because I totally wasn't paying attention - yeah, I looked afool.

And - some 'popped-collar' got on the elevator with me and rode it ONE floor - which really pissed me off, to the extent that I almost commented.

Whatever - I'm going to read IBT - and everything is going to be better - or I'll just start drinking!!!!!

Quite the conundrum

So - I'm fucking tired - I was up late last night - I got up late this morning, such that I had to drive to school in order to make it on time (okay that's not true, but I needed coffee & a bagel) - I just got home a little bit ago and now I have a decision to make......should I develop a loose agenda for the OUTlaw meeting tomorrow or take a nap - b/c there isn't time for both....after all LOST is on tonight and I wouldn't miss that for an opportunity to run the Texas State Lottery.

Advice anyone?

An amusing encounter....

So I'm watching a neighbor's house - and today I was watering some plants when this older woman approached me from across the street. I promptly introduced myself, as to avoid the whole 'Who are you? and why are you at so and so's house' conversation. Anyway I got involved in this 15 minute small-talk marathon where I learned little bits and pieces about the neighborhood - when I told her that I lived down the street - she asked me where...so I told her and her response was quite funny. She was like "Oh, you really shouldn't be renting - you should buy a house in the neighborhood - it's a great place to live and raise a family....a guy like you has got to be married and you'll certainly be wanting to start a family soon" at which point she listed off several properties in the neighborhood that were for sale.

So long story long, I responded that "I most certainly wasn't married and I definitely wasn't expecting children anytime soon" to which she responded "Oh...you'll come around".

I just found it kind of funny.

Stories of a Stranger

Let me preface this by saying that this is the first album that I've been anticipating in a real sense since Madonna's American Life.

After listening to a little bit of the pre-released stuff - I downgraded expectations - I was thinking that this was a "we've joined a big label" sell-out album. But like the good consumer that I am - I logged on to iTunes this morning before I got in the shower - and purchased it. Within 20 minutes I was listening to it waiting for the bus. At first I wasn't sold on a few of the songs (But this isn't unusual - my first judgments about shit are usually shit - I mean look at Emily - I thought she sucked at first - but she grew on me - and now I couldn't imagine being w/o her - she's like chest hair). But after listening a little more intently - I'm practicing the whole 'cover to cover' then repeat technique.

Currently - as of 4:41 GMT - my favorite song is Tragedy in Waiting - of course this is likely to change repeatedly over the next 24 hours.

A side note though - American Life is a great album - so fuck everyone who thinks that Madonna is washed up - Especially a certain skank who I knew who liked to randomly quote Foucault at the most inopportune times (Note to everyone not from DE - this isn't a reference to anyone I know in Pittsburgh)!

Commander in Chief

I, like many others (including my friend Chris), thought that this should would be largely fluff. Happily, I've been proved wrong. It's actually quite good - and fairly grounded in reality while still providing the drama that I'm searching for on a Tuesday night.

The best part is that it's not as outlandish and unbelievable as the West Wing....which generally goes like this (pre-current season):

Josh: OMG Toby there is some insurmountable crisis that can't ever be conquered.

Toby: I know - the world is falling apart and there's nothing we can do.....

President Bartlett: Not to worry guys - I'm a politician that stands on principle - I'm also from New Hampshire and I've solved every problem that has vexed the American Republic since its founding during my presidency. I can handle it. After all I went to China in a wheel-chair and managed to negotiate something super-important even though my health was seriously in jeopardy. And let us not forget that I solved the Middle-East peace problem with the introduction of 700,000,000 U.S. soldiers. Right - see that's preposterous - but CiC isn't like that - they tackle much more pragmatic concerns - like tension between the White House and Congress. And they occasionally say War Powers Resolution - which is a plus.

TV Update

I'm updating my Top 5 favorite current television shows.

As I look at this list I realize that ABC has captured a monopoly of my TV viewing - but hey - they're making a great product.

So much to Blog about and so little time!

So I figure that I stick to the important stuff - and not about how my 1-day soup diet diet failed miserably with Chinese & Hot Dogs.

Right, so today I had class from 9:00 to 10:00 a.m. - that's right folks, just one hour. And you wanna know what time I got home - 8:30 - yeah - 10 and a half hours later. So here's the kicker - at most I did 4 hours of work....and that's being generous. So what, you ask, did I do with the rest of my day - Well, I'll tell you.....though not productive in the traditional sense - it was very very fulfilling!

I had a collection of conversations, while maintaining my post at the same table in the student lounge.....hour after hour, that were just as valuable as Professional Responsibility in Transnational Litigation. Everything from bicycles seats to Harriet Miers to kittens to puppies.

I got coffee twice - and I saw a guy that I had seen last week totally having a crack attack on the street and fighting with thin air - today he was just pointing at stuff.

I asked a federalist a question that should never be asked "Show me where in the Constitution...." - Of course he did & I quickly capitulated.

I listened to the new O.A.R. cd about 4 times - which consequently...is very good.

I got a Hot Dog from the O's - which consequently...was nasty and overpriced.

But anyway - here's the really important part. This evening I was sitting in a coffee shop, listening to music (O.A.R. Stories of a Stranger, Nasim Joon), drinking coffee while reading Foreign Affairs and the Constitution, as an ambulance raced down Forbes...and I had a reflective moment: Today was such a kick-ass day, not because I got a lot done or because I did anything of relative value for the world, or because it's likely that Tom Delay is going to jail - but because I had a really relaxed long day that filled with little insignificant adventures and casual, but rewarding, conversations with a bunch of really fantastic people.

I really love the regular old ordinary 'good' day.

In IBT today we were discussing a case, I thought that I had a nice piece of succinct information to offer. So amongst a sea of silence, I raised my hand - the professor obliged - and I proceeded to spit out a bunch of horseshit that only slightly resembled the thought in my head. But it was kind of funny because I wanted to discuss an FCN Treaty (Friendship, Commerce & Navigation) - and I ended up referring to it as a "Friendly Comerce" Treaty.....okay - not that funny, but whatever.

Stupid Human Tricks

You know what....sometimes I do the stupidest things, that ultimately end in catastrophe, and after the post-mortem I'm always like "Why are you such an idiot?"

For example. Today I got off the bus, walked home and approached my front door with my iPod in one hand and with my Cell Phone in the other (checking messages). I walked up the steps and opened my bag with my pinky finger, in order to get my keys. My keys are attached to a clever little key leash inside my bag - this is instrumental in keeping my keys from becoming 'lost' - I never have to take my keys off said leash b/c it's like a foot long. So I manage, my hands still full mind you, to get through the outer door of my building. So, with hands still full, I try to open my mailbox, ended up grabbing my keys sort of underhandedly in order to get the mailbox key - it was an awkward grip & the key leash had kind of wrapped around my forearm such that there wasn't much leeway. Anyway I managed to get the key to the keyhole, but couldn't get it in - so rather than put some of the shit that I was carrying down - I pressed myself up against the wall in order to get that little bastard in. After about a minute - yes a full minute - I found myself standing on my toes trying to angle this awkwardly held key into the keyhole - of course everything fell apart. The key went in, the phone slipped out my my hand - while trying to catch the phone I basically threw my iPod at the wall - then my bag fell off my shoulder and I took a hard knee into the tile to prevent it from landing hard.

I know - long story - but I wanted to blog about what an idiot I am some times - my god - I would have saved so much time, embarassment & pain if I had just put my shit down to get the fucking mail.
