Things that make you go Hmmm......

So - I had an interesting conversation today....the details of which aren't all that important except that this person - Deep Throat (for the purposes of this post) - basically said that he/she would be more offended by a racist remark than a homophobic remark.

So I was thinking about this, and since I can't be wholly objective - I'm curious what people think?

Are racism and homophobia equally deplorable...or is one more acceptable than the other? As a baseline I realize that neither are acceptable, so were talking about them in relation to one another.

There seems to be a mutually overarching intolerance concern, but apart from that there are differences between the types of bigotry....e.g. relative status of the affected groups, social integration, social acceptance, statutory discrimination, economic and educational opportunities, incidence of violent hate-based crimes, etc..... So maybe these differences justify the statement "Racism is worse than Homophobia" - I don't know.....I tend to think that they're equally deplorable and that placing Homophobia second to Racism will continue to relegated the GLBT population to second-class citizenship, even w/r/to their quest for civil rights, but there are other arguments to be made.

Grand Coalition (Mistake)

Hey Germany....what's up - who the hell is voting for a party with "Christian" in the name anyway....Thankfully Merkel will have to mitigate her agenda to avoid Bundestag gridlock - but she's been Chancellor for a week and it looks like she's taking Germany's foreign policy a touch to the right - Perhaps her Christian Party has a crush on Bush's Christian Ass.

In the Post today it was noted that she wants "Closer U.S. Ties" and she's going for the let bygones be bygones dance. I'm thinking that it's not quite time for that yet - Germany opposed the war in Iraq - and it wasn't just Schroeder - it was the people of Germany - and now Merkel is all over Bush's ass, let's help out, but we're not gonna send troops - She's also distancing herself from the Schoeder/Chirac Franco-German Alliance (Big mistake in my humble opinion), among other things.....I'll bet that she has a little bit of a Thatcher fetish.

Whatever - let her run with the Bush crowd for a couple months - until it breaks that some German-trained Iraqi police officer tortured someone at the behest of the U.S. - and watch that public opinion fall......Hello no confidence vote - and before you know it Welcome Back Social Dems!

Sarkozy is Nuts

Right - so Nicolas Sarkozy is a nutbag - this guy just said that France did not want "those people that nobody else in the world wants." He added, "We want selective immigration." This is a piss-poor response to the recent unrest.

Seriously - there are a lot of people who feel isolated and marginalized by French society - certainly a statement of this nature isn't going to aid the situation. It's just a blind political move b/c this bastard wants to be President in 2007. All I've got to say is that I hope that mainstream France is too smart for this BS - for to fall prey to such fearful manipulation....well that would be....so American.

Maybe Immigration needs to be reformed - but you don't have to be mean about it - you've got five million people in largely immigrant ghettos who aren't leaving France anytime soon. Let's make a good-faith integration and affirmative action effort and leave out the "The Immigrants are the cause of all of Frances problems" - excuse....because that is.......so 1930's Germany (except back then it wasn't immigrants.) This is the type of shit that LePen and LePen alone should be saying.

Societies have problems - blaming groups of people (aside from Republicans) seldom solves these problems.


Also - all these new anti-terror laws seem a little shady and unnecessary - Europe already has some pretty pro-law enforcement legal regimes - do they really need to go farther - Perhaps we should focus on tolerance and acceptance (of diversity - Get rid of the headscarf ban) and perhaps the domestic fears would be ameliorated.

A few notes from this week.

I got to be a judge - empanelled for an appellate moot court on the Padilla case - A pretty good time - I'm a big fan of my own non-professional demeanor.

Make-up class for SexLaw on Tuesday - Emily and I broke up - Assumes the risk looked like she was drunk and she played around on the internet for the entire class period - Super-rude.

Commander in Chief was pretty damn good last night - the Prez. pardoned a mentally disabled woman set to be executed in Texas (read: Dumbfuckistan) - I love make-believe!

I'm going to judge Tom Beline tomorrow (I know, you're all thinking "Of course you are" - and I will, but I'll be on another moot court judicial panel - so I'll be double-judging his double-collared ass) - I'm reading his brief now - Tom's a lot smarter than I thought.....I'm kidding - I've always thought he was a pretty smart guy.

Emily and I decided to 'give it another shot' - our friendship that is - so we're back together - at Crazy Mocha, where coincidently the 1L stopped by - and he was, dare I say, enjoyable to be around.

Okay - catch up is over - I'm planning a blog-fest tomorrow - because I'm sooo over school right now.

I've got other shit to worry about - like preparing to judge some oral arguments tomorrow.

Ehh, Afternoon & a Rebound Evening

The follow-up to my Zen-ful Morning wasn't so hot - an 'interesting' lunch experience, followed by a much deserved nap.

But everything rebounded by the evening - w/ an enjoyable dinner in the company of Michael & Steph.

Zen-ful Morning

Pretty Kick-ass morning today.....

I got up early and took Jen to the Bus Station (after some stressful Thanksgiving transportation drama....which largely played out at Whole Foods w/ Michael and Steph).

Being awake, and resolute that the previous evenings stress warranted the purchase of a new toy - I was downtown-bound, heading for a T-Mobile retailer. Of course being that I know almost nothing about where to park downtown - I opted for the Station Square option. You go with what you know.

After safely stowing my vehicle - I walked to the 'T' station. As I approached I witnessed a magnificent sight - two LRV's passing one another at the entrance of the Mt. Washington Transit Tunnel.
Right - I fumbled for my camera and only caught one of them - the other was safely beneath Mt. Washington. A triumph nonetheless.

Okay, I realize this is lame on about 42 different levels. Namely, that I think that LRV's are a beautiful sight, that I had my camera on, that I captured this picture and that I posted this picture on my blog.

But whatever - Lightrail kicks serious ass.

Anyway - once downtown, I had grabbed a coffee, and oddly enough I went to a Bagel shop that had a working toaster - I know, bizarre. So I enjoyed my breakfast in Market Square on a really cold, crisp Pittsburgh morning.....and then I went and bought my new Sidekick II. It's hella cool.

I was home by 10:00 a.m. and feeling rather accomplished - I seldom get up before 10:00 on days where I don't have school, let alone get anything done. So I checked my e-mail and found that there was a new comment on my Blog from a very fabulous DRA - who's pretty much the nicest guy ever. Thanks Donnie, you're the best.

New Manifesto

I'm wondering if Ariel Sharon's new political party will include legalizing Palestinian Massacres as part of it's official platform.

If only Israel were party to the ICC....it would be kind of neat to see such a politically prominent official tried for crimes against humanity. Come to think of it, if only the U.S. were party as well, I'd love to see Rumsfeld, Bush & Co. stand before an international tribunal.

Isn't it almost funny, how a nation partially responsible for ending the Nazi tyranny 60 years ago, and a nation whose citizenry whose faith was the target of that tyranny - don't feel that there should be international accountability for such inhumane treatment. Wow, what a statement - Genocide is bad, except when we do it.......

Ted Koppel is bowing out this evening - his last episode of Nightline will air on ABC. It's a little bit sad - he seems to be one of the few newspeople left any credibility or integrity. Our 'free' press has become increasingly concerned with reaching certain 'valuable' target audiences and telling them what they want to hear - and Ted has remained something of a refresher, you know real journalism and all - a place where in-depth doesn't mean 90 seconds.

Transport Clarification

Tom commented on my previous Transport post and I want to make a few quick clarifications.

First of all - I agree with pretty much everything that Tom said in his comment.....except that lame Field of Dreams analogy.

Secondly, my first point wasn't meant to convey a general dislike of the Pittsburgh "T" - I'm a huge fan/supporter of light-rail systems/projects. In upcoming posts I'd like to go further into depth, but for now it should suffice to say that LightRail is teh Rule!

Third, I'm against the North-Shore connecter, as proposed, not because it's an expansion of the system, but because I think that it's an ineffective use of funds that could be utilized elsewhere to expand the system and build ridership. Look - I'd love to be able to hop on the "T" to head to a Steelers game - but with limited funding I think we should be making the smartest decision about how to expand our transport infrastructure - how to ease mobility and provide access to our poor & elderly, while trying to capture choice riders. I just don't think that is achieved by giving South Hills suburbanites a traffic-free ride to Heinz field.

Anyway - more on this topic later. But Tom....You and I see largely eye to eye.

Biden Kicks Ass

Today Joe Biden attacked the Iraq policy at a Council of Foreign Relations lunch - this guy is sooo kick-ass, even though he did a weird support/disagree-thing with Murtha's position [Go PA] - which is actually pretty cool too, and here's why:

First off, Biden rocks....I want a Clinton/Biden dream team in 2008 [read: never going to happen, but I can dream].

Secondly (and to my point) - I think that Murtha is right! Get the hell out of Iraq, everytime I hear "Stay the course", in my head I hear John Kerry saying "How do you ask a man to be the last mane to die for a mistake". Krugman wrote a great column this week - totally on point - entitled "Murtha's Right" - which I would totally link to, except NYT is shady and charges money for Krugman these days. Anyway - his bottom line argument was - hey - this shit isn't going to get better. Nobody is really (this analysis only takes into account non-idealogues) contending that Iraq is going to 'turn a magic corner' and the U.S. mission will get easier or get done. So if you have to decide between (a) losing in Iraq & pulling out or (b) losing in Iraq & losing the U.S. Army - you choose option (a). Because it's the only rational choice.

But, putting that aside, Biden is being a damn cool character - supporting Murtha, but distancing himself from his 'media circus position' - hopefully he is tapping into mainstream America on this one......Biden is such a uniter, although I guess that's not very presidential......


In retrospect, I guess this post title should have been - "Murtha Kicks Ass (as supported by Paul Krugman) & Joe Biden is cool too" - Oh well.

Mountain ~ Molehill

Sometimes really little and inconsequential things get under my skin.....and I can't get them out.

Like tolerating intolerance........and it's really pissing me off right now. Federalist Homophobes shouldn't be defended (character-wise) by accepting liberals under the mantra "He's just being a guy" - for two primary reasons.
  1. It's demeaning to the male gender - because there are plenty of men who aren't homophobes
  2. Because 'accepting liberals' shouldn't condone/defend this kind of behavior - that's not to say that you shouldn't befriend these individuals - but you certainly shouldn't make excuses for there bullshit attitudes.
That's all.

Seriously, how great would it be to see Tom Delay in jail? I think that would be a big step for my personal healing over the 2000 election (I'll be bitter until the day I die, but baby-steps) - I really just long to see him in an orange jumpsuit.

Of course the likelihood is slim....but I can be hopeful.....meanwhile he [Delay] is trying to get some of the charges against him dropped as soon as possible - for fear that he won't be able to regain the Majority Leader position. This guy probably doesn't even concieve of the possibility of criminal penalties, he's just worried about the political ramfications.

Though, I guess it's of no consequence - because come 11/7/06 - we'll be taking back that seat. Peace Tom - you suck!

Talk about ducking the issue.....

The government is pretty shady....okay, that's a good baseline - but more specifically:

Today the government indicted Jose Padilla after holding him for 3 years without charge or trial. Normally, one might be inclined to say that this is a good thing - that the government should indict and try individuals as opposed 'illegally' detaining them. But the bottom line is that Padilla's case has gone up and down the courts for the past couple years - and the courts need to rule on the legality of the government's actions

The Supreme Court was almost certain to hear this case - and the petition for cert. was just filed (to appeal Luttig's whacked out 4th Cir. Opinion), so by indicting this guy - the issue is now all but moot.

So, it's good that the criminal process is functioning, but it sucks because now the court has no case before it, presumeably to say that the government can't indefinitely detain American citizens....pursuant to the President's Commander-in-Chief powers.....at least when the guy is captured in the U.S..

I guess the silver lining is that the Executive is scared, at least scared enough to worry that the Court might tell them to stop doing what they're doing - so they're going to comply with the law.......for now.

Transport Infrastructure

BTW - as my blogging activity indicates - I'm procrastinating from doing research for my Note draft, which was due last Thursday.......damn.

Anyway - this is going to be my last post today - but I wanted to mention something about our local transport infrastructure.

The Post-Gazette has reported that a portion of Pittsburgh's light-rail expansion is in jeopardy because of budgetary constraints. I just have a couple of things to say - they'll be largely conclusory - but I hope to back them up in the coming weeks.
  1. Pittsburgh needs to think regionally - the light-rail expansion isn't really gonna do much for the city in the long-run - it's going to give a couple thousand suburbanites and easier way to get to Steelers games and a couple thousand convention-goers an easier way to get to their hotels. WE NEED to think about regional solutions - we need a comprehensive plan to improve transport in the City and the region to improve access & mobility and reduce the auto-dominance/dependence in the region.
  2. We need regional government - at least insofar as planning is concerned. The biggest problem facing the region is the fiefdoms cum municipalities that are proliferate - each fighting for its own interests, while affecting the disintegration of the region as a whole - we need authoritative co-operation. As it is now - the city can only focus on Downtown - because that is all that the suburbanites care about and will pay for - and that's all that they'll allow politically. If forced to think/plan as a region - the whole region becomes important - including les miserable that don't live in Mt. Lebanon. Development will be forced to become sustainable - If the suburbanite are forced to internalize their externalities we can expect more efficient and equitable markets in housing and social services
  3. Port Authorities 2020 Vision is a pile of shit - its a lowest common denominator report, which will do next to nothing for the City except for maintaining the status quo. We need a plan that seeks to innovate and change and one that demands implementation sooner rather than 15 years from now.
  4. Also, though unrelated to the light-rail funding problems. Maglev is a waste of time and money - it's only $500,000,000 from the federal gov't - the project is going to cost over $2,000,000,000 - I say - walk away - tell the FTC they can keep their money and take that $1.5 billion that the state and local gov't's would spend and build a comprehensive light-rail system in Pittsburgh - complete with cross-city links!
Okay - I'm going to do some work now.

I feel a little dirty.....

I was just looking at the Business Section of the newspaper.....I think I need a shower now.

I came across an article warning investors to pay attention to the fees associated with investing in mutual funds. It got me thinking - Mutual funds are really investment instruments that ostensibly shield the investor from the 'personal responsibility' of owning the various companies held by the mutual fund.

Okay - let me explain this synaptic misfire.....this morning, when I was on the phone with Dolly (see my prior post "Brief Healthcare Rant") I was recanting a 'news story' from Weekend Update last night, where Tina Fey was making fun of the fact that Halliburton had fleeced the U.S. gov't for a couple billion dollars. Anyway she brought up that her step-father owned Halliburton stock and that it had done well. After hyperventilating for a good 45 seconds - I asked how he could possibly sleep at night, knowing that he supported such a dastardly company.....she responded "Oh, he doesn't own it outright - it's part of a mutual fund" - This is kind of fucked up.

Of course, it's not like my social outrage is representative of the nation, but still I don't think that people should be able to hide behind their investment choices - look the bottom line is that there are corporations that do horrendous things in this world - such that nobody should be willing to give them a dollar of investment - and at the very least if people are going to become part-owners of these fascist endeavors - they should have to stand up and say "Yes XYZ Corp. is fascist, but I don't care because they pay good dividends."

It seems to me that Mutual Funds legitimize willful blindness on the part of the investor - Just make me money, I don't care how. One of the tenets of the free market system is that people are to make informed choices - it seems to me that Mutual Funds reduce the amount of information that goes into the choice - perhaps leading to bad outcomes.


Not that I'm part of the investor-class - but if I were - I wouldn't be able to stomach the thought of owning horrible companies like Halliburton, Wal-Mart or ExxonMobil.

People with Hair Plugs aren't all bad....

Case in Point - Joe Biden, my surrogate Senator - who has been kicking some ass on crazy Supreme Court Nominees - he voted against Roberts and he's sure as hell not going to be voting for Alito. Why you ask?

Because - Alito is crazy - so crazy that he apparently disagrees with Baker v. Carr - you know the case, where Brennan kicked ass and said that the issue before the court was judicially manageable, that it was as simple as: One Man, One Vote! Yeah - apparently arbitrarily drawn legislative boundaries - to keep the black man down, are a-okay in Alito's book.

Well Biden isn't having any of that bullshit - he's definitely pissed about Scalito's positions on Abortion and Affirmative Action, but he finds the Reapportionment position intolerable - such that, perhaps a filibuster is in order - Go Biden - stand up for fairness and legitimacy in government.

Brief Healthcare Rant

I've got this friend - she's a pretty cool camper, but unfortunately her parents weren't of the right ideological orientation.....so she struggles with things that come easily to the rest of us. Nationalized Health Care is the perfect example.

(As an aside: knowing that she and I disagree on this issue - I pretty much try to bring it up/steer any conversation we have, onto Healthcare policy. You'd be surprised how easy it is to transform a conversation about daily everyday minutiae into one of national policy.)

So my friend - let's call her Dolly Filartiga, after my new favorite case - anyway Dolly grew up in a pretty conservative/libertarian family - primary mantra being "personal responsibility" (BTW, this term has done wonders for my ability to control my gag reflex....) - so she thinks that people should pay for their own healthcare. For her it's all about 'fairness' - her favorite point of argument is "I'm a smoker, and I assume the risk that I'll get cancer, it's unfair to force anyone else but me to pay for my cancer treatment" she has a similar argument for obesity. Of course there are about a million ways to counter this position, not the least of which is that to me 'fairness' isn't implicated when you deny healthcare to 17% of your populace because they're poor - but hey I guess that's why they have charities (Heavy Sarcasm Intended).

Enough with the back story.....

Dolly called me today - to complain about something relating to Bush's Asia Trip - I can't really remember - I was reading IBT. Anyway, after half-listening for awhile - I grabbed an opportunity to refocus the conversation, and we had a good 30 minutes of Socialized Healthcare v. The Status Quo - where I learned a number of things:
  1. People who have had 'personal responsibility' ingrained in their being since the age of 3 - aren't easily persuaded
  2. Idealogues balk at being confronted with 'hard' evidence that their 'way' costs more and delivers less
  3. 'Fairness' might be the most relative term in the world
  4. To make headway you really need to get personal, e.g. "If you're so committed to personal responsibility, perhaps you should voluntarily repay the gov't for subsidizing your student loans - or give back the Pell Grants awarded to you."
  5. Rationality and Logic don't work for people ideologically 'attached' to certain positions - this is really point number 2 rephrased - but damn - Only in the twisted world of conservative 'personal responsibility' ideology does it make sense that the U.S. spends double the amount on healthcare that the rest of the western world spends in order to receive healthcare that is below average.
One last thing - as per the cruel functioning of our current healthcare system - namely that more than 10 million kids don't have access to healthcare - her suggestion: Lower Taxes, and people will give more to charity - and these charities can take care of these indigent kids.

All I can say is: What the fuck? Don't our kids deserve better, don't they deserve public accountability as opposed to 'look the other way' reliance on personal donations.....Christ - I'm beginning to understand why the Republican Party has such a big Christian base - if you're going to hold a position, hold it religiously.....regardless of logic, reason, fairness, or compassion for your fellow man.

One last gripe (really this is the last one) - it really pisses me off when people 'make it' in this world with the help of government assistance (e.g. public education, state higher education, subsidized loans, etc.) and then once they've taken their benefit - they're so quick to deny others the opportunity afforded to them.....in the name of ideological adherence. Holy hypocritical.

If it's good enough for Paris Hilton....

I'm seriously contemplating the purchase of a T-mobile Sidekick II - these things seem pretty bad-ass. They're like Blackberry's for non-douchebags (Sorry Chris, nothing personal).

They're action-packed with e-mail and web capabilities (I could give a shit about Instant Messenging) - which means that I could get/send e-mail or blog anywhere that I had a signal.....which sound pretty good to me.

And - Paris Hilton has one, and that's hot.

Good news folks, my Yellow Scare is now over.

This morning I got out the clippers and did away with most of the yellow atop my head. I'm back to normal, and I feel a lot less like that 18 year old "I just came out - now I'm getting my tongue pierced" gay kid. Which rocks, because now I can get back to being that mid-twenties "I take everything way too seriously/personally" gay kid.

Shut down

So - I was prepared to deal with some confrontation with the individuals that I alluded to in my prior post "Utter Frustration" - but I wasn't prepared for everyting......

First of all, upon reading my post later - I knew that it obviously wasn't the case that my friend wasn't heading out to Alternative Bar Review b/c the venue happened to be a gay bar......but nonetheless I was thinking that he should have wanted to come because it was an event that I organized, under the auspices of Outlaw.

I thought that this was a pretty unassailable position.....alas, I was wrong - upon the inevitable confrontation he quickly brought up a remarkably parallel "tables-turned" situation - such that I was disarmed and speechless.

Basically - although I'm not conceding anything.....I need to live up to the expectations I have for my friends.....that or I need to start paying them - because they're some really good people.

One last thing

I just wanted to say......Dean Jones was right when he told our class that we would learn much more from each other than from our coursework......I truly enjoy the countless interactions I have with my classmates, the way we engage one another, the way we challenge one another to be better people (without doing so explicitly) - to me this has, thus far, been worth the time and money....

Tonight's Alternative Bar Review was fantastic.

Tons of great people, good turnout, lots of my straight friends - not getting bought drinks......

Good times & I was really happy with the outcome.....in fact I indulged myself in a 'zen' moment - unfortunately that was very short-lived, but whatever, all's well that ends well.

So, maybe I overreacted a bit today, maybe I was being too cynical, maybe my friends are perfect....or at least as perfect as I need them to be......

Tonight, I was expected to find a bunch of people tossed in a bar out of a sense of obligation, but that's not what I found.....I found a bunch of great people getting together for a good time, and nobody seemed to give a shit that we were in a gay bar.

I love having my expectations shattered, and I love knowing great people.......especially when they probably haven't read anything on this blog in the past 14 hours....and once they do, they'll be like "Damn - that kid's a headcase!"

Second Hat.

So this blog has worn many hats.....drunken shout-outs, healthcare jabber, football rage, & political disgust.....right now I'm reverting to another Shout-Out......so please indulge me, because I gotta say this.

As I mentioned/posted earlier - today = not so great - tonight = great. Not in any small part because of Michael and Steph....you guys are kick-ass - I seriously want to be just like you guys (right down to your writing instruments) - right, I'm joking about that......or am I. Whatever, you two (individually as well) are super-duper refreshing to be around. I don't know exactly how to say what I want to say....except that, wow, now I'm totally going to sound like "Homo - after-school special" but - okay wait a minute - I'm totally off track, whatever you guys rock....

Let me preface this by saying that this afternoon I was feeling pretty shitty, and I was seriously contemplating getting on that aforementioned plane to Philly - because sometimes when you're feeling bad you just want to go to a safe, warm, fabulous place.

Anyway - tonight turned out to be fantastic, for reasons to be elaborated upon in my second and third posts, but the evening was capped off by returning home to Greg's comment on my prior post "Utter Frustration" - particularly point number three. To be honest, I think that it was better to come home to this e-mail notification after a fun evening as opposed to seeing it before I went out. For I fear that had I seen it earlier, I may have been like "yeah yeah yeah...." - Anyway - Greg you're awesome, I've gotta say that you comment made me a little misty........probably because I've been a touch emotional today - but thanks, you kick ass!

You're good people Greg, and you've totally got me in your corner.

Okay so here's the deal....

I've got essentially three things to say - but i'm going to put them in separate post because I think that they're each worthy of individual recognition.

Note to all: Although it's passed 2:00 a.m. - and I did just recently get back from a bar......I'm totally sober - I only had 3 drinks in 5 hours....which explains why I was able to drive.

Three little words

Oh My God!

I almost forgot

The intent behind my previous post was wholly ineffected in that post......what I wanted to say was - I don't want anyone to go to 5801 tonight, who doesn't want to/can't go for fear that I'll be "judging" individuals as homophobic. Trust me, I know better - I don't believe that any of you are homophobic, I was just being a little bratty earlier.

So....you might be a little sensitive if.....you're me.

Right - so two posts ago I was expressing some frustration, perhaps I overreacted just a little bit.

I think it is largely a function of the fact that there is so much fucked up bullshit that adversely affects the gay and lesbian population......and I mean if my 'liberal' friends in law school aren't 100% on board, what kind of prospects do we [the GLBT population] face with the rest of the population.

So, yeah - maybe I freaked out about some seemingly innocuous comments/actions - but come on people, you're in like the 95th percentile in terms of education in this country.....

It's almost like we're trying to isolate ourselves

At a time in world events when the United States arguably needs its allies the most, its actions speak exactly to the contrary - I mean come on - Spain sure isn't going to be happy about using their airports for illegal extraordiary rendition. And the E.C. is obviously going to be pissed if the CIA has established and is operating secret torture chambers/prisons across East Europe.

It's almost as if the Bush Administration lives in Bizarro-land where if you need international consensus, you flout international law & where if you need to reduce anti-american islamic fundamentalism, you create a terrorist-breeding ground in the Middle East.

These guys clearly aren't the brightest....let's hope the American people don't make the same mistake again [and again] - Wake up America - Vote Democrat.

Utter frustration

How hard a line should someone take with respect to homophobia??

I'm really frustrated and annoyed right now. I'm caught up in a mental dilemma over whether or not I'm justified in being annoyed by certain people's actions/comments over the past couple of days. I don't want to be an overly sensitive bastard, but in the same sense I don't think that I should tolerate veiled intolerance.....

For example:

  1. I was present for an exchange between a friend of mine (Jane Roe) and a friend of hers (John Doe) - where John asked Jane if she was going to 'Alternative' bar review, after which he laughed condescendingly. Upon noticing my obvious annoyance - he said "I don't know why I laughed" to which I responded "Neither do I" and then I walked away. Later Jane actually defended this gentleman on the ground that "Come on, he's just a guy" - which in my view is a categorically invalid justification - especially coming from Jane. So - basically I think that this guy is a dick....now maybe I'm overreacting, I mean really, how much can you learn about a person from one little laugh in one little conversational exchange........well, maybe a lot. If the whole idea of a gay-themed/gay-positive bar review is funny to this guy, to me that reads that his gut reaction to gay people/gay culture is that it isn't to be taken seriously - and to that I say: "Fuck You."
  2. Secondly, a another friend of mine (John Doe II) has an ongoing bet with someone regarding the number of drinks that he thinks that he'll be bought tonight at bar review, the logic being that he's a guy & he's going to a gay bar, obviously he'll be profusely hit upon. Christ, hello stereotypes - gay people don't want to date/fuck straight people.....get over yourself.
  3. Lastly, a good friend of mine isn't coming to this event tonight and it really makes me mad/sad.....I know I'm not justified, and I know it isn't an external marker of the value of our friendship, but I can't help but wonder that if I had organized this 'Lefty' bar review at Shady Grove as opposed to 5801 - that he might have made an appearance.

I don't know - I'm just kind of disappointed in my friends - I want them to be perfect and they're not - which is understandable, because none of us are - and maybe I'm reading too much into this shit - but right now I feel like the people that I care about and respect a lot, are being dicks - not all of them of course.....and I don't think that anyone is being intentionally dick-like....but nonetheless.

I kind of want to say Fuck it - not go tonight, and hop a flight to Philly to have dinner with Chris & Gena..........there's a 5:10 on Southwest.......

BTW - I've haven't used anybody's real names just in case they've got their future sights on becoming a judge or a law professor......wow, I'm damn courteous.

Has Religion been Resurrected as a Basis for Discrimination?

Okay - this is totally a loaded question.....and it deserves a big ole conversation, but I'm tired and I've conversed a lot today....so I just wanted to say a word for now - but I want to revisit this subject.

I've recently been corresponding with the Target Corp. because of a policy that they have w/r/to their in-store pharmacies & pharmacists. Basically, they [Target] allow their pharmacists to NOT fill prescriptions for emergency contraception if such a medication does not comport with their religious beliefs. I think this is an impermissible stretch of the freedom of one to practice their religion. To take a libertarian perspective (and we all know I ain't libertarian) - the pharmacists rights can only extend so far, until they infringe on another citizens rights. In this case this (hypothetical) pharmacist's rights are given priority over the woman with prescription in hand. Why? Because it's a religious belief? If so, someone needs to explain to me why someone's intangible 'faith' is given priority over a real substantive right of an individual.

A friend of mine gave me some valuable insight.....he said "Andrew, there's a reason that they're aren't many fundamentalist Christians who are abortion doctors or Jehovah's Witness' that work in ICU's" - their religions don't comport to the requirements of the job. So you've got a choice: find a way to square your beliefs with your job....or find another job. There are tons of pro-choice Catholics out there, ostensibly they separate out their beliefs from their politics or from their jobs (if they're politicians).

I'm not saying that you can't be a Pharmacist if you're pro-life politically and you don't think that the law should allow emergency contraception - but you can't be a selective Pharmacist - Public Health & Women's Rights are far too important to be left in an individuals subjective belief structure. Just fill the damn script and then go home and write your congressperson.

Umm, so - Congress has apparently decided to keep a lot of the autocratic, totalitarian measures of the patriot act. What the hell is going on - Bush's approval ratings suck, a bunch of Republicans are sure to be going to jail some time soon, the citizenry think that the country is heading in the wrong direction - and most importantly the population thinks that the President is unworthy of their trust. Why then are the Dems conceding on this one? The President is clearly a "lyin' kind of a guy" who is super-shady - why give him the legislative authority to be an asshole?

Democrats: STAND YOUR GROUND - Fuck the Patriot Act - it is a facist tool, to be utilized by an administration whose guiding principle seems to be lunacy.

Long Overdue Post about Clichy-Sous-Bois

Right - so everybody knows what's been going on in France, and I'm sure that nobody needs a late-twenties law student rehashing the situation.

Though I do have a couple of things I wanted to note:

First, yesterday PM de Villepin visited Aulnay-Sous-Bois, which is the other initiating suburb (along with Clichy-sous-bois) of the unrest. Anyway - I was struck by his comment that the struggle against injustice and discrimination "should mobilize us all, every French man and woman" - wow - injustice and discrimination - national concern? I know - many of us (Americans) aren't used to such national commitments - I think the fundamental difference is that in France the 'state' is to protect/provide for the people, whereas in American the 'state' is to provide for a 'market' for us to provide for ourselves. (Obviously I'm generalizing and I'm definitely not speaking to the national security context.) And, largely, I think there will be major reforms, akin to the changes that took place after the European Heat Wave of 2003 - large-scale social problems require and receive large-scale actions.

Second, the Integration Model has been proven to be wholly ineffective at Integration. The integration model was France's elitist solution the disparity/discrimination amongst the immigrant population and 'the rest of the country' - the state wouldn't recognize differences in ethnicity or religion for the purposes of ending discrimination because everyone was supposed to be united in their respective French-ness - that these problems would fall away in successive generations. Yet, we're now on Generation 3 and almost nothing has changed. Now I imagine that the French will be forced to implement a quasi-American solution, namely Affirmative Action (and I say quasi-American b/c the Burger and Rehnquist Court's have all but eviscerated Affirmative Action programs in the U.S. - under a rationale remarkably similar to the "Integration" models rationale) - The cycle of racism & elitism will need to be broken, and it will likely need to be broken in a forceful manner - I argue for staged-in quota's for all public employment - with similar measures for the private sector.

Third, the recent riots have shown that although these poor suburban population may have not been integrated fully into French society - they've certainly acclimated to the French Revolutionary spirit, which I think is pretty fucking cool. If society is fucking you over nobody is listening, strike, riot, revolt - make the government respond to the ills of society. Hannah Arendt once argued that the French Revolution couldn't be referred to as an event, because it's continuous and ongoing - the revolution lives within the culture and tradition of France, and from time to time it seizes the people and forces societal change. Arendt is much smarter than I, so I'll offer my pittance of a concurrence and simply say "Sounds good to me".

Fourth, Sarkozy is a bastard, but a helpful bastard. I can't stand the guy - and his ambitions are clearly for Elysee Palace - but because of his draconian statements and strict response to the unrest - he's taken a lot of the wind out of the crazy FN leader (yes, LePen is actually arguing that France deport these people). So Sarkozy - "Keep on Keepin' on" - at least until everything calms down and then you too look like a lunatic - it's time for the Socialists to occupy Elysee again.

Lastly, I'm not sure how I feel about the emergency measures passed in Parliament. I mean, if you're gonna use emergency measures, Parlaiment should authorize it (Bush would probably have firebombed Clichy-sous-Bois pursuant to his 'commander in chief' powers) - but anytime you restrict 'the people' in their ability to assemble and associate - I get a little nervous. This I am sure about though: They shouldn't have used a law from fifty years ago, that was meant to deal with civil unrest in the wake of the Algerian conflict ----- A lot of the citizens who are rioting are of Algerian descent and at least symbolically its a bad move. To me it says "Hey we subjugated you grand-parents, and now we're going to subjugate you with a law that arose from that situation" - Seems a little stupid to me.

Anyway - those are just some of my thought about the current civil unrest in France.....

Of all things, I'm not concerned about the health of the Fifth Republic - she shall persevere - Vive la France, mais n'oublions pas la liberte, egalite et fraternite!

Security (?) Council....

I was reading the Post today, and I came across an article about Bill Clinton - speaking out against the war in Iraq - my first inclination was...."Oh no, tell me he's not going to say that the war was illegal..." But Bill is much too smart for that, he wouldn't say that the war was illegal, at least not from a UN perspective, because he acted in much the same manner when he was president.

As one could guess, today's International Law class focused upon the authorization for the use of military force. And though, I love Bill Clinton....I gotta say that he was just as shady - legally - as the current administration for seeking UN authorization for military action against Iraq.

My forthcoming comments are only in regards to the Iraq situation - I don't know nearly enough about the Kosovo conflict to say one way or another whether I think that proceeding without explicit UN authorization was a-okay (though it seems to me that if 'ethnic cleansing' is going on - it's universally objectively verifiable - and so any country should be willing to step up and take action - immediately).

Regardless, today in class we discussed at length the arguments of the current administration arguing the legality of the current Iraq war. (One of which was used by Clinton to bomb Iraq in the 90's) The crux of the dominant argument is "Hey the UN authorized force" "The UN authorized a cease-fire, suspending the authorization of force" "The cease-fire is contingent upon Iraq doing a bunch of things" "Iraq hasn't done those things" --> "The suspension goes away" "We're authorized to attack"

To me this is such bullshit - Hello the authorization for force was passed in 1990 (Security Council Resolution 678) and it's purpose was to get Iraq out of Kuwait. These hyper-technical arguments are clearly against the spirit of the UN Charter. The UN system was set up so that countries couldn't fuck with each other using really deadly means - the UN was vested with executive authority to authorize force within the community of nations. Read the preamble of the UN Charter - it's amazing.

There simply isn't a rational human being who could say that this hypertechnical argument (used by both Clinton & Bush) is consistent with the intent and goals of the United Nations....any attempt to so otherwise argue - is disingenuous at best.

Article 2(4):
"All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations."

When are we going to live up to our international obligations???? The international community stands a helluva lot better a chance at getting along if we all work together - equally - and leave the doctrine of unilateralism behind, a vestige of our imperialist past.

Compassionate Cruelty

The Bush Administration (and right-wingers) are shady - for a number of reasons....one of them being this absurdly non-comprehensive prescription drug plan.

The Washington Post reports about some of the difficulties with the bill, the biggest problem though wasn't really mentioned. The bill - only provides coverage up to ~$2,200 (at 70%) and then stops covering everything until the beneficiary reaches $5,000 (after which it covers 95%) - so there's a $2,800 hole that the beneficiary has to pay entirely out of pocket.

And - here's the best part - Medicare can't use it's buying power to try to negotiate lower prices from the drug companies....

Lastly - the beneficiary can't procure supplemental insurance for that $2,800 hole - the bill prohibts supplemental insurance as a condition of signing up.

Who was this Bill written to benefit? The drug companies get to maintain the status quo.....and recipiants get only quasi-coverage. I guess this was the most efficous bill that the Republicans could tolerate, you know - you've gotta protect corporate america - who cares if grandma has to stop buying medications after she reaches her $2,200 annual limit.

The Priorities of the West

What the hell are we [Western Nations] doing in this world. We're missing the point - we need to take an absolute stand on Human Rights issues and we need to do it RIGHT NOW.

This passed week Iran executed two more men, guilty of homosexuality, amongst other specious charges - how is it that we [the Western World] have allowed this to happen. It is one thing to have an academic debate over cultural relativism and cultural imperialism - but it is quite another when people are being murdered at the hand of a 'fascist' state!

That this has been allowed to occur in our 'modern' world is unforgiveable - Chirac, Blair, Bush & Merkel need to get to their god damn microphones and deplore these actions at the top of their lungs.

Micro-Sleeping

Apparently, when you're really tired - you're brain disconnects and shuts down for a few micro-seconds, and often times you don't know it. This must have been the case for me last night, when I subscribed to The Nation at 1:45 a.m. - I know this only because I received a confirmation e-mail this morning, and I have no recollection of actually subscribing......wow this is gonna be one hell of a brief, Padilla - I bet you can taste your freedom already.

For lack of a better phrase, What's the matter with Kansas? If you want to believe in magic and make-believe - go ahead - nobody is going to stop you, but just don't call it science. And don't assault scienctific theory because it doesn't comport to your religious beliefs. This whole thing is so silly and the ultimate disservice is upon the children in the public schools

Public Restrooms

Okay - I just exploded a bottle of soda all over my table in the library - as such, I needed to get some paper towels....the logical place to go was the bathroom. My little excursion got me thinking.....

Public Restrooms should really contain two distinct physical spaces. The first space being where one can urinate and wash their hands (as I needed to do, thanks to my explosive soda) and the other SEPARATE space where one can take care of 'other' things. I say this because all I wanted to do was wash my hands and grab some paper towels....and yet I was subjected to a smell that (for lack of a better term) could gag a maggot.

There must be a better way......

Dilemma

So - what's a law student to do??????

I've got a Journal that I like - and a note topic that I'm crazy about and that I can't wait to write about - yet at the same time I've got two briefs to write in the next two weeks. Oh yeah - and those briefs, they're grade-determinative! I simply don't think that I have the time to finish this first draft of my note - and this isn't something I want to half-ass.......

So, should I be a total douche-bag and ask for an extension???? Or should I quit the journal????

Of course - I really want to continue with my topic, but at the same time I hate the thought of being that asshole who's like "can I have more time" - b/c I've never been that person......

Wow

I haven't blogged in like three days. How about that. Damn school getting in the way of my real priorities.

Whatever - I'm heading into a hole for the next 15 days - In order to write 2 briefs and 1 journal note (yeah, I may be quitting this journal) - what fun. But on the positive....I was riding home on the bus today and I was thinking.....

I really like that my computer knows certain things that other computers (that aren't in law school) don't know.
